Bollcoin reported on October 19, citing Cailian Press, that the China Securities Regulatory Commission (CSRC) has drafted the "Guiding Opinions on Advance Compensation in the Securities Market (Draft for Comments)" and is now soliciting public comments. It states that advance compensation will be explicitly supported and encouraged. First, on the basis of the Securities Law's provision that the party making advance compensation has the right to seek recovery, it further clarifies that the party making advance compensation may, for the purpose of recovery, obtain materials on the advance compensation situation from the investor protection fund company after making the advance compensation (Article 15). Second, it clarifies that the CSRC may, in accordance with laws and regulations, take circumstances related to advance compensation into consideration in administrative licensing reviews, administrative penalty discretion, and the supervision and management of integrity in the securities and futures market (Article 18).
